GOALS AND OBJECTIVES OF UKRAINIAN STATE POLICY TO ENSURE STATE SECURITY: PROBLEMS OF DEFINITION IN THE CURRENT LEGISLATION AND POSSIBLE WAYS TO SOLVE THEM

Abstract

Based on the analysis of current legislation, the article identifies the existing problems of defining the purpose and objectives of the State policy on ensuring State security in it. In particular, the author establishes that in Section III “Goals, Directions and Tasks of the State Policy in the Sphere of State Security” of the Strategy for Ensuring the State Security of Ukraine (2022), the goal or goals of the State's security policy are not clearly defined, and are in fact reduced to the tactical level of fulfillment of its main function by one of its subjects, namely, the Security Service of Ukraine, which indicates that the authors of the Strategy have a misconception of the State policy for ensuring the State security as a political and legal phenomenon in general. The defined tasks of the state policy on ensuring state security are not specific and declarative, they include tasks of the state policy on ensuring other types of national security, as well as tasks and measures of individual subjects of ensuring state and national security. Therefore, with a view to improving this Strategy, the author offers his own vision of its content. Thus, when formulating the goal of the State policy on ensuring the State security, the author substantiates the need to proceed from the interpretation of the categories «State security», «State policy on ensuring the State security» and their essence, since this is crucial for a clear understanding of the desired result of the security policy in this area.

The tasks of the state policy on ensuring state security should be defined by the directions of this state policy. At the same time, it is necessary to distinguish between the tasks of the state policy on ensuring state security and the tasks of executive subjects of ensuring state security. In order to achieve the defined goal, the Strategy, along with the definition of directions and tasks, should also reflect the main measures necessary for this.

The author concludes that with a view to eliminating the identified shortcomings and inadequacies in the current Strategy for Ensuring State Security and preparing a new version of this legal act, the proposed approach to defining the purpose and tasks of the State policy for ensuring state security should be submitted for discussion at a scientific and practical seminar or round table, and based on its results, a special working group should be established from leading scholars and practitioners of Ukraine related to the national (state) security sphere.
